Biden is not wasting any time trying to get his judicial nominees through to counter Trump’s record number of judicial nominations.

Top officials in the Biden administration say they are placing far more emphasis on judicial nominations and plan to fill slots faster than Democrats have in the past. At the Supreme Court, the administration could face the retirement of Justice Stephen G. Breyer, 82, a potential vacancy Biden has vowed to fill with a Black woman. And even as Biden signs a burst of executive orders and presses for a $1.9 trillion coronavirus relief package, senior administration officials view judicial nominees as one area where the president will invest early political capital.

Former President Trump was extraordinarily successful in nominating very right wing judges, some of whom had questionable knowledge of the law and light judicial experience. President Biden was gifted with control of the House and Senate and a unique opportunity to counter Trump’s numerous right wing judges with his own nominees. The real question turns to the Supreme Court and who will be stepping down in the next few year or two thus opening the highest court in the land to a makeover as well.
